Terms of Use
These Terms of Use (“Terms”) are a legal agreement between you and Murphy Digital LLC, a Missouri limited liability company (“Murphy Digital,” “we,” or “us”). They govern your use of our website (murphydigitaldev.com) and our apps, including Trivia Fair, Ultimate Sports Pickem, and Survivor Pool Edge (the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and accounts
You must be at least 13 years old to use the Services. If you create an account, you agree to provide accurate information, keep your credentials secure, and be responsible for activity under your account.
2. Acceptable use
You agree not to:
- violate any law or the rights of others;
- harass, abuse, or harm other users, or post unlawful, hateful, or infringing content;
- attempt to gain unauthorized access to, disrupt, or reverse engineer the Services;
- use bots, scrapers, or other automated means to access the Services without our permission; or
- use the Services to cheat, manipulate results, or defraud other users.
3. Entertainment purposes only
Our apps are entertainment tools for organizing and playing games among friends and communities. Murphy Digital is not a gambling operator and does not accept, hold, or pay out wagers or prizes. Information and tools provided in the Services, including anything in Survivor Pool Edge, are for entertainment and informational purposes and do not guarantee any outcome.
4. User content
You retain ownership of content you submit to the Services. You grant Murphy Digital a non-exclusive, worldwide, royalty-free license to host, store, display, and use that content solely to operate and provide the Services. You are responsible for your content and represent that you have the right to submit it.
5. Our intellectual property
The Services, including their software, design, text, graphics, and trademarks, are owned by Murphy Digital LLC or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use in accordance with these Terms.
6. Apple App Store
If you download our apps from the Apple App Store, you acknowledge that these Terms are between you and Murphy Digital only, not Apple, and that Apple has no obligation to provide maintenance or support for the apps. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
7. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if needed to protect the Services or other users.
8. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, Murphy Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or $50.
10. Governing law
These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction.
11. Changes to these Terms
We may update these Terms from time to time. We will revise the effective date above, and continued use of the Services after changes take effect means you accept the updated Terms.
